Conditions of Residence 1. For the purposes of this document the Hotel will mean The Palm House. 2. The guest, by signing the registration form, warrants that he duly authorized to sign and bind himself, his principal and each member of his accompanying party to these conditions of residence & failing such authority, agrees to be personally liable for all amounts arising from the residence of himself & his accompanying party as set out at the Hotel. 3. The guest & his principal agree to pay not later than the time of departure (unless prior written arrangements have been made with the Hotel management) the room rate as determined by the Hotel for the period of residence together with food, beverage, any sundry charges & Value Added Tax, incurred by the guest & his accompanying party during their stay in the Hotel. Departure time is 11h00 and arrival time is 14h00. Periodic payments must be made if account exceeds the credit limit designated by the Hotel, & bills are payable on presentation. 4. A guest account from the Hotel management shall constitute proof of indebtedness of the guest or his principal or his accompanying party & of the particulars therein for all purposes including any action instituted by the Hotel against the guest or his principal. 5. The guest agrees that after his departure, the Hotel may possess goods left behind & authorises the Hotel after giving one month’s notice to the address registered by the guest of its intention to do so to sell same, privately or publicly, at the Hotel’s discretion at such price as the Hotel may determine & offset proceeds of such sale against possible indebtedness or to hold such proceeds for a period of three years pending any claims by the guest for those proceeds, failing which they shall be deemed as having been donated to the Hotel. 6. The guest hereby agrees, on behalf of himself or of the members of his accompanying party, that it is a condition of their occupation of the Hotel that the Hotel’s Proprietor & Management shall not be responsible for the loss or damage to any property brought by the guest & his accompanying party upon the premises, whether arising from fire, theft or any cause & by whomsoever caused, or arising from the negligence (gross or otherwise) or wrongful act of any person in the employ of the Hotel, or for any damages sustained by reason of any injury caused by any negligence of wrongful act by the Proprietor or by any employee of the Hotel. The guest & his accompanying party may hand to the Hotel for safekeeping, money &/or valuables when a special receipt will be issued accordingly. 7. Where appropriate, the masculine gender shall include the feminine gender or vice versa, & single shall include plural. 8. The guest hereby consents to the jurisdiction of the Magistrates Court having jurisdiction over the guest in respect of any proceedings in connection with the stay of the guest & his accompanying party in the Hotel. Notwithstanding the aforegoing the Hotel shall have the right of instituting all or any proceeding connected with such stay in the Hotel in any division of the Supreme Court having jurisdiction.
